Newsletter service terms and conditions

Rules for the electronic provision of the newsletter sending service by P.S. Trading Stolker Peter Spółka jawna.


  1. These terms and conditions (the “Terms”) set out the rules for providing the newsletter sending service (the “Service”) to interested persons (the “Service Recipients”).
    • 1.1. A Service Recipient is a natural person with full legal capacity and, in cases provided for by generally applicable law, also a natural person with limited legal capacity; a legal person or an organisational unit without legal personality to which the law grants legal capacity, acting through an authorised person.
  2. The Service is provided by P.S. Trading Stolker Peter Spółka jawna, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000135571 (the “Service Provider”), with its registered office in Ołtarzew, 05-850 Ożarów Mazowiecki, ul. Południowa 2, Poland, tel. +48 22 863 11 00, e-mail: narzedzia@pstrading.com.pl.
  3. As part of the Service, the Service Provider sends messages to the e-mail address indicated by the Service Recipient containing information, including commercial information about services, promotions and other commercial information concerning the Service Provider's business offered by the Service Provider and cooperating entities (the “Newsletter”).
  4. Use of the Service requires the Service Recipient to have a computer or other device with an Internet connection and an active e-mail account.
  5. The Service is sent free of charge for an indefinite period.
    • 5.1. The Service terminates when the Service Recipient sends a request to remove their e-mail address from the Newsletter subscription or unsubscribes using the link included in a message sent as part of the Newsletter Service.
    • 5.2. The Service Provider may also end or suspend the Newsletter service after prior notice to Service Recipients at the e-mail addresses they have provided.
    • 5.3. The Service Provider has the right to remove an incorrect or non-existent e-mail address provided by the Service Recipient.
  6. Each Newsletter contains the following information:
    • information about the Service Provider,
    • the actual content of the Newsletter,
    • information on how to change the e-mail address to which the Newsletter is sent, and information on the possibility and method of cancelling the Service.
  7. Use of the Service is possible after completing prior registration steps consisting, in order, of:
    • entering the Service Recipient's first name and e-mail address in the form on the website,
    • giving consent to receive the Newsletter in accordance with the Terms at the e-mail address indicated by the Service Recipient,
    • confirming the correctness of the e-mail address provided by the Service Recipient by clicking a link, active for 24 hours, sent in an automatically generated message to the e-mail address provided.
  8. The provision by the Service Recipient of a correct e-mail address and its verification in accordance with point 7 of the Terms are necessary for the effective conclusion of a contract for the provision of electronic services within the meaning of the Polish Act of 18 July 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2020, item 344) between the Service Recipient and the Service Provider concerning the provision of the Service.
  9. Rules for processing personal data:
    • 9.1. The Service Provider is the controller of personal data for the purpose of providing the Newsletter service.
    • 9.2. Providing personal data is voluntary but necessary to provide the Newsletter Service.
    • 9.3. Personal data is processed by the Service Provider in accordance with the law and solely for purposes related to the provision of the Newsletter service.
    • 9.4. Personal data is stored until consent to receive the Newsletter service is withdrawn and thereafter on the basis of the Controller's legitimate interest (e.g. defence against claims).
    • 9.5. In matters concerning the processing of personal data provided during the Newsletter service not regulated in the Terms, the relevant provisions of the Privacy Policy and the Information Clause available on the website apply.
  10. Complaints regarding the Service provided by the Service Provider:
    • 10.1. Complaints may be submitted by post to: P.S. Trading Stolker Peter, ul. Południowa 2, 05-850 Ołtarzew, Poland, by phone: +48 22 863 11 00 or by e-mail: narzedzia@pstrading.com.pl.
    • 10.2. A complaint should include: the e-mail address provided by the Service Recipient when registering for the Service, a description of the matter being complained about, and the e-mail or postal address to which the response to the complaint should be sent.
    • 10.3. The Service Provider shall consider a complaint without undue delay, but no later than 14 days from receipt of the complete information enabling it to be considered.
  11. Final provisions:
    • 11.1. The Service Provider reserves the right to amend these Terms. Service Recipients will be informed of the amendments in an e-mail as part of the Newsletter service no later than 14 days before the amendments enter into force.
    • 11.2. The Service Recipient may cancel the Newsletter service before the amendments to the Terms enter into force. Otherwise, the Service Recipient is deemed to have accepted the amendments to the Terms, which become binding on them after 14 days.
